Inquiry:  Hi, I received a ticket for a burnt out headlight I thought that I could pay when I renewed my stickers unknowingly that was not the case and they suspended my licence October 16. I was pulled over and charged for driving while under suspension not knowing my licence was suspended as soon as that happened I paid the fine and reinstated my licence. My court date is the end of the month. Do I have any chance at all of fighting this charge?

Response:  A charge of DRIVE UNDER SUSPENSION is a very serious offence carrying a maximum total payable fine of $6,250.00, a mandatory suspension of licence for 6 months, and discretionary jail up to 6 months.  Given the serious nature of the charge issued against you, you may wish to seek out legal assistance in guarding your interests.  We could certainly see if there would be any legal grounds upon which to have the charge withdrawn, or negotiate with the Crown Prosecutor to see if an agreement to a less serious offence could be reached.  If you would like to speak with one of our staff in more detail, we offer a no-cost initial review of cases via our toll-free number 1-866-801-8299.
