Inquiry: I have recently received a speeding ticket for doing 70 km/h in a 50 zone. The normal posted speed was 80, but there is construction further down the road and I missed the new signage. Regardless, the officer actually reduced my speed from around 90 to 70 at the roadside. If I chose to fight this through yourselves, would the prosecutor have this roadside reduction info at your meeting, or is there a chance you could further reduce this to below the demerit point level, say 60 in a 50. Thanks, Mark.
Response: We would know for certain what information the Prosecutor is aware of once a disclosure of their evidence has been received and reviewed. Whether or not an offence of speeding has been reduced at roadside, does not preclude the presence of a valid defence to the charge.
