Inquiry: My son was involved in a highway collision and charged with Careless Driving. The ticket is dated 2004 although the occurrence was 2014. Is this fatal?
Response: The dating issue is certainly one of the defences that we could look at, but it is not a guaranteed grounds upon which to have the charge thrown out. A charge of CARELESS DRIVING is one of the most serious offences that can be issued under the Highway Traffic Act. Barring the charge being eliminated based on the dating issue, your son may have other defences to the charge, or the charge may be negotiable to a lesser offence.
