Inquiry:   I recently received a ticket for speeding in a Community Safety Zone on a Saturday morning in the town of Caledon. According to the Highway Safety Act Section 241.1 signs must specify the hours, days and months the sign is in effect. If this sign did not specify such information, is the ticket still valid? Thanks!

Response:  Ontario does not have a “Highway Safety Act.”  Ontario is governed by the Highway Traffic Act which does not contain a section 241.1.  Community safety zones are in effect 24 hours a day, 365 days a year.  You may however have other legitimate defences to your charge that could be examined in either reducing or eliminating the charge.  If you would like to speak with one of our staff in more detail, we offer a no-cost initial review of cases via our toll-free number 1-866-801-8299.
