Inquiry: Hi there, I was stopped by two cops and told me that I ran through a red light originally. Then I told them I didn’t. They came back to their car and check the video, it showed that I ran through an amber light instead. So they issued me a $325 for violate HTA 144(15) and said the light changed to red when I crossed the intersection. The intersection was clear and I drove through with normal speed. I was driving my girlfriend’s car because she was sick. As i am not familiar with her car, I don’t think it’s safe to stop as I have to break it hard, witch might hurt my gf. Is there a chance for me to win this case?
Response: We could certainly get a release of evidence from the Prosecutor’s Office to review for grounds to defend the charge. It is also likely that we could at least have the charge reduced from the current 3 demerit point offence, to a lesser 0 demerit point offence. Intersection related charges are generally very simple and inexpensive cases to resolve so long as there have been no collisions involved.
