Wet Parking Ticket

Monday, January 23rd, 2012

Inquiry:  I got a parking ticket, but it rained overnight and the ink on some parts of the ticket have washed away. Do I still need to pay this?

Response:  Unfortunately we do not deal with parking tickets.  However, I think it would be safe to assume that no respective damage was done to the copy of the ticket filed at the Court.

Quebec Parking Ticket

Wednesday, January 11th, 2012

Inquiry: Received a parking ticket in Quebec City over Christmas. The officer who wrote the ticket misspelled the licence plate on the vehicle. I am an Ontario resident and the car that I was driving was my neighbours vehicle. Interestingly enough the vehicle (due to the owners illness) was sold back to the local dealer and the plates removed.  Based on the above, what do I do….pay the ticket or not.

Response:  Unfortunately, we do not deal with parking tickets as the cost to defend them would generally be more than the anticipated benefit.  I am unable to provide you with accurate information regarding the consequences of not paying the ticket or how to best defend the charge.

Parking Tickets

Saturday, January 7th, 2012

Inquiry:  My son has outstanding parking tickets from at least 10 or more years ago.  He wants to resolve them. He incurred these Tickets in Toronto where he worked for a security company.

Response:  He will want to contact Toronto Court Services with his Driver’s Licence number to track down the information.  If he has outstanding parking tickets from that long ago, it is possible that his licence may currently be suspended and he should not drive until the matter has been sorted out.

Parking Ticket

Wednesday, December 28th, 2011

Inquiry: My husband and I parked our car in what we thought was legal parking but I guess wasn’t. We parked our car at 6:00pm and when we returned to our car later that night we had a parking ticket for 115 dollars. However the officer wrote that the ticket was issued at 5:05pm which is impossible being that we didn’t park our car there till 6:00pm. Is there any way to fight such a ticket?

Response:  You certainly can contest the ticket and the instructions for doing so should be provided on the parking ticket itself.  Unfortunately, the cost of hiring a paralegal to fight the parking ticket on your behalf would be higher than the cost of the ticket itself.  If would like to have us represent you in the matter, you can reach our staff via our toll-free number 1-866-801-8299.

Parking Ticket – Handicap Zone

Sunday, April 10th, 2011

Inquiry: This weekend in Rim park Waterloo was the Ontario Provicial Volleyball Tournament. Parking was all full. People were parking everywhere. It was crazy, I parked on a yellow painted area next to Handicap Parking spots. There was a vehicle in the Handicap parking space next to me on the right. on the left was a lane way. The lane is usually two cars wide but the entire parking lot was filled and an entire row of cars were parked along the cirb on the left of my vehicle. so to clarify, cirb, lane way, my car parked on yellow painted area then the Handicap parking spot to my right. I Ended up crossing the Handicap Parking line with my right side of my car by approox. 1 foot. I got ticketd the full price. Your opinion would be greatly appreciated. I would never take a Handicap parking spot. The entire spot was available. I have phots documenting the entire parking lot and all the infractions that were present when I got back to my car.

Response:  Unfortunately, we do not handle parking tickets.   These charges do not become a part of your driving history and carry a fine as their only penalty.  The cost to hire legal representation would likely be greater than the benefit you would gain at Court.  You could however attend Court on your own behalf to see if the Prosecutor would at least agree to lower the fine.

Private Property Parking Problems

Friday, December 10th, 2010

Inquiry: I was parked at a Go Transit lot in Ajax, On in the lot of a bankrupt restaurant adjacent to the station. I received a ticket for being ‘parked on private property’ without consent from the town of Ajax. It is unsigned by the issuing officer, is this a valid technicality to have it tossed if i take it to court?

Response:  Unfortunately we do not deal with parking tickets and your question falls outside of our area of practice.  You may have a valid issue if the Officer has failed to sign both your copy and the copy filed with the Court.

Towed away…on the wrong day!

Tuesday, November 30th, 2010

Inquiry:  I received a violation for parking in a tow zone on Nov 24. However, the officer wrote December 24. Today is November 30. May I contest this?

Response:  It is possible that the officer may not file the ticket with the Court given the error.  You may have a valid defense to the charge given the large error in the date.  Unfortunately, our company does not generally deal with parking related offenses as the cost of defense would generally be higher than the fine we would be working to prevent our clients from paying.

Parking Ticket Problem

Friday, October 1st, 2010

Question:  I just parked at a local deli downtown for maybe 10 minutes and got a ticket! I’ve parked there before and asked a ticket officer whatever they’re called if I had to buy a ticket if I was just running in & he said no!

Do I have a chance to fight this?  I really would not like to pay it.

Answer:  Unfortunately we do not deal with parking tickets.  You may want to check the local signage to see if you were infact in volation of local parking bylaws.  If not, you could always file the ticket with the Court to have your defence heard.  I hope this helps!

Best wishes,

Parking Ticket While In Vehicle

Sunday, September 5th, 2010

Question:   I received a parking ticket while I was in my car waiting in a no parking between hours. The parking enforcer was speaking to me and then start insulting my intelligence because while he was talking to me ge was printing the ticket out. What should I do and what souls I say?

Answer:  Good morning.  Unfortunately, we do not deal with parking tickets.  If you would like to contest the charge, you may wish to read your local bylaws regarding parking to see whether the charge is valid.  If you feel that the parking enforcer was in error, then you could decide to file the ticket with the Court to have your defence heard.  I hope this helps!

Handicap Parking Problem

Saturday, September 4th, 2010

Question:   Have our disabled sign on left side dash of our car- good till 2014. Parked in a wheelchiar parking spot at Wallmart in Woodstock. It accidently moved down slightly to the left not displaying the 4 clearly, was not aware of this, everything else showing very clearly. Got left a ticket for $300.00 is this something we can fight as believe this is so unfair, unjust and wrong. I am disabled and on limited income.JIM

Answer:  Good morning Jim.  Given the size of the fine and that the charge should have no effect on your insurance rates, it would likely not be cost-effective to hire a paralegal in your case.  However, you could file the matter with the Court and speak with the Prosecutor once a Court date has been set.  If you provide proof of your valid parking permit, the charge may be withdrawn.  I hope this helps!
