Inquiry: I received a ticket for offence 139 (1). Fail to yield from driveway. That is all the offence he put on there. Also cross streets were incorrect. Name was spelt incorrectly. What should I do pay or try to fight. Really would like demerits lowered. Help.
Response: The charge you’ve listed is a 3 demerit point charge. We will need to know more specific information about what occured to be able to advise if a lesser charge is applicable. As for the errors on the ticket, they may not be fatal errors to the Prosecutor’s case. We do however need to be aware of them incase they can be used to argue for the the dismissal or reduction of the charge. If you pay the fine, you will be convicted of the charge and recieve the demerit point penalty. Inquiry: Peace officer wrote me a ticket (Offense Notice) and filled in the Section Number as 209(6)(b) when in fact he should have wrote 209(6)(a) if anything.
Traffic Safety Act is:
209
(6) No driver of a vehicle shall fail to bring the vehicle to a stop:
(a) at every place where a stop sign is erected;
(b) when approaching a railway crossing, and a signal person or automatic signal indicates the approach of a train.
My question is if I have a case to plead not guilty as I failed to stop at a traffic light on a highway bridge. There is no railway crossing.

Inquiry: I recieved a speeding ticket for driving 15 over in a 40km zone, the officer failed to write my name correctly on my ticket. Do i have to pay it?

Inquiry: Hi my names is Vanessa I am 18years old and I am from Ontario. I have just recently been stopped in the district of Hull,Gatineau by SQ police officer. I was on the 50 thinking that the limit was 100 so i was goin 101 at that point when i was pulled over i was advided by the police officer that the limit was actually 70 and that I was going 31over and that is what he gave me plus a 191$ fine. Their are no demirit points indicated on the fine but i understand that they are not oblidged to indicated them… and since i was stopped in Quebec will it go by the Quebec demirit system or Ontario ? I am a G2 driver… and i am eligible to go and get my G… The officer wrote my middle name wrong on the ticket Joell when its suppost to be Joelle, Also their were two dates on the fine the first one he wrote for the date i got stopped 2012/01/2 witch is incorrect because i got stoppeed january 21rst 2012/ but he correctly wrote it the second time witch is where hes suppost to write when he gave me the ticket. Response: The errors may or may not be a problem for the Prosecutor. The concern I have with your matter is that since your licence was a G2 class licence on the date of offence, you may be subject to a mandatory suspension of licence on your Ontario licence under the new novice driver legislation should the charge to go conviction as is. Inquiry: My fiance was recently in a car accident where he hit the ditch and totalled a company vehicle. The officer gave him a ticket for undo care and attention but wrote his birthday wrong. Is the ticket still valid?
Response: It sounds like he may have been charged with Careless Driving, which is a very serious offence. Unfortunately the date of birth issues will not be a fatal error in the Prosecutor’s case. Subject speeding ticket can’t read license number clearly

Inquiry I received a speeding ticket. The officer’s writing isn’t good. The date
could be the 9th or 7th. And the licence letters could be interpreted more
than one way. Also, he didn’t ask for insurance or registration and took no
notes as he was in a hurry to pull over others. Just stood behind my car,
recorded licence and issued ticket. Is this contestable?

Inquiry: I received a speeding ticket on January 6th 2012, but the officer wrote 2011 on the ticket. Can the ticket even be registered?
Response: It is possible that the Officer may not file the ticket given the error. However, you will want to follow-up with the Court to confirm whether or not the ticket was filed. I would recommend contacting the Court approximately one week after the offence date, and then another week after that to verify. If the offence is filled and goes to conviction, you may be stuck with the MTO and insurance repercussions. Inquiry: My husband and I parked our car in what we thought was legal parking but I guess wasn’t. We parked our car at 6:00pm and when we returned to our car later that night we had a parking ticket for 115 dollars. However the officer wrote that the ticket was issued at 5:05pm which is impossible being that we didn’t park our car there till 6:00pm. Is there any way to fight such a ticket?

Inquiry: I received a ticket for using a handheld communication device while driving. On the offence notice, the office wrote M in the space where you are supposed to indicate sex. I am clearly a female. Will this make any difference in my case if i choose the trial option?
Reponse: The incorrect gender on the ticket will likely not be an issue if the cases proceeds forward to trial, but we do need to be aware of these types of documentation errors. The charge does show as a conviction on your driving history if it goes to convication. The effect this has on your specific insurance rate will depend upon your personal demographic and driving history.
