Inquiry: i have a suspended license in nova scotia and was wondering if i am able to get my license in ontario

Inquiry: my son had a fender bender, he was charged with following to close. He signed the ticket and we paid his fine by check and posted it in the mail. On April 7 2012 we picked up our mail and there was a notification that his Licence was suspended for none payment of the above charge. we went to the Licence office and they further inform him that his licence was suspended under the the new rules for G2 drivers for 30 days. We did not receive notification of that, and they now tell him that the total suspended time only starts upon the turning in of his Llicence. yet they tell him that he could have been charged for driving under suspended licence at any point since Feburary 27. 2012. how can this be correct?
Response: Unfortunately, that is correct. It would have been prudent to follow-up with the court to ensure that the cheque had been received without any issue. When the charge went to conviction and the deadline for paying the fine passed, you’re son’s licence would have gone into suspension for the non-payment of fine. As well, being a G2 licence holder, a conviction for any charge carrying 4 or more demerit points will incur the escalating sanctions under the new legislation.
It is important whenever a charge has been issued to know your rights and what penalties are being faced. Almost all Follow Too Closely charges can either be thrown out at court or be reduced down to lesser offences. Which in this case would have avoided the two licence suspensions and the impact that the conviction and suspensions will have on being able to ensure him as a driver.

Inquiry: my son has been caught twice driving wth suspened liscence due to unpaid fines. He did not go to either court date. We are traveleing to the US will he have something come up under his passport ? Coud he have warrant for his arrest . How do we find out?

If your son has not attended his court hearings, then there may be a warrant for his arrest. Inquiry: our daughter has unpaid fines totaling $7300.00 from a car accident and another incident before the accident of having no insurance and a expired plate in Ontario .she left and moved out west doing nothing about the fines . Since then they have been given to a collection company, she is still driving in Alberta what happens to her if she is pulled over by the police for any reason. Thanks.
Response: Being stopped for driving under a suspended licence carries very serious penalties. The best advice would be for her to check with her local licencing agency to verify if the the suspension has been placed against her Alberta driver’s licence as well.

Inquiry: my licence was suspended back in 1998 for driving with no insurance i have 2 conviction one in toronto one in mississauga my fines are around $13000 one of my convictions have gone into collections does this mean i cant do anything about this anymore i was young then and now have recently come back to canada and need to get a licence again but can no way pay all those fines now but can make a payment plan. Is there anything i can do i really need to drive again i have to small kids and need to get around. please can you help me thank you
Response: The first step would be to speak with a court clerk about the outstanding fines to see if a payment plan can be arranged. If the Court will approve an extension of time to pay the fines, then you should be able to get a licence approximately one week later. Charges such as OPERATE MOTOR VEHICLE – NO INSURANCE carry massive fines. Consulting a paralegal in such cases can often mean reducing the penalties significantly or even having the charge eliminated completely. Inquiry: I can’t find out whether my driver’s licence is suspended, cancelled or invalid. I’ve sent countless e-mails to 3 different sections of the MTO but to no avail. Is there a way to find out this information, preferably for free?
Response: If you go into an MTO office, a clerk should be able to provide you that information. You could also go to the Service Ontario website and pull your 3 year driver’s abstract which would likely show any suspensions applied against your licence. A 3 year record check usually costs about $13 to $15. If you suspect that your licence may be suspended, you should not drive until you have resolved the suspension issue. A charge of DRIVE UNDER SUSPENSION carries a total maximum fine of $6,250, a mandatory 6 months of further licence suspension, and up to 6 months of jail.

Inquiry: i was ticketed for failing to stop at a stop sign and forgot all about it. last night i was pulled over and informed my license was suspended the officer then gave me a notice of suspension and a ticket for driving while license suspended. can i fight this?

Inquiry: One of my employees at work has a suspended drivers license for impaired driving from some time ago. A while back he moved a company vehicle on private company property that is not publicly accessible about 130 feet or so in the name of expediting the job he was doing. I was always of the impression that you didn’t require a license to do such things but he was disciplined and the company threatened to call the police. Is this indeed illegal?
