Inquiry: I received a fail to obey lane light ticket. The fine was325 and demerit points however because the cop said I was a “nice person” lol, he reduced it to 86 dollars and no demerit points. I want to fight even the reduction because I feel I did not run a red light at all. If I decide to pay the 85 and be done with it will it affect my insurance rates. I am a 35 plus years clean driving record driver.

Reponse: The best advice in determining the insurance impact would be to contact your insurance broker directly; however, your broker may require you to identify yourself by name or policy number before providing any feedback. The charge itself may be defensible depending on what the Prosecutor has to work with. If you would like to contest your charge, we offer a no-cost initial review of cases via our toll-free number 1-866-801-8299.

Response: The dating issue may not be a fatal error. The charge itself is a 3 demerit point offence. If the charge can not be thrown out due to the dating error, there may be an alternate defence to the charge that can be found, or it may be possible to have the charge reduced down to a lesser offence. If you would like to review the details of your case in more detail, we offer a no-cost initial review of cases via our toll-free number 1-866-801-8299.

Inquiry: Hi, I was driving my dad’s car and got a ticket for unsigned registration. Is there anything I can do about that? It seems pretty unfair as I was told by someone after that if I didnt have the registration on me I would not have gotten a ticket a all, I would have just been given a warning to go to a police station within 24 hours with the regsitration to prove that I have one. Is there anything I can do about this? Thank you

Response: It is possible that the Prosecutor may agree to withdraw the charge. Failing that, the case could be taken to trial to see if there is any defence to the matter. If you would like to review your case in more detail, we offer a no-cost initial review of cases via our toll-free number 1-866-801-8299.

Inquiry: hello. the cop stopped me and asked for insurance i searched in the car but
did not find it cause i cleaned the car that day unfortunatlly i found the insurance slip in my car trunk inside with the insurance compay contract. but it was too late cause the cop left and i found it after he left. i got my insurance in the same day when the cop stopped me… i insured the car in the same day in the morning before the cop stopped me and got temporary insurance slip for 30 days and recieved the original insurance in 10 days … now tthe cop gave me a ticket and told me to show in the court with the insurance. so my question i purchsed the insurance in the morning and got the temporary iunsurance slip and i noticed that the insurance effective day starts next day at 12.01 Am midnight … i have the the insurance contract signed INt 25/01/2012 and the insurance effective day is midnight 26/1/2012 at 12.01 am is that going to be a problem ??? let em know. thanks

Response: Your description of events is a little hard to decipher. I would recommend speaking with one of our staff so that we can sort out exactly what you are charged with, what penalties are pending at court, and how to best proceed in resolving the issue. We offer a no-cost initial review of cases via our toll-free number 1-866-801-8299.

Inquiry: I just recieved a letter in the mail stating that my licence was suspended do to an unpaid fine. so heres the story. I got pulled over for speeding like 16 over in a 50 and I hired a lawyer to fight the ticket. they went to court on my behalf and had the demerit points removed but I was to still pay the fine.. I moved since hiring the lawyer and they mailed me a notice of what happened in court but I never rrcieved it. so I just assumed they had everything dropped fines and points. I read that under some section I dont need to be told that my licence will be suspended if I do not pay the fine. I am inquiring if there is any way I can have the suspension removed from my record? It is only a 40 dollar ticket. I made an honest mistake I will pay for my mistake but I dont want a suspension on my record. I am not going to drive while suspended. I am trying to fix this messs asap as I drive for work. thanks for any advice.

Response: It is very likely that the record of the licence suspension will have an impact on your insurance rates. Unfortunately, by not updating your address with either the Court or your legal representative, the grounds for an appeal would be very weak. The MTO does have a review process that you could attempt going through to plead your case in having the suspension removed, although I can not advise on whether they will see your situation as having any merit. Worse case however is that they deny your request. I hope this helps!

Inquiry: I was involved Ina car accident last month. This morning I was served with a traffic ticket brought to my house by police (I was served after a month). And the ticket is CARELESS DRIVING. There are few mistakes on my ticket. My name is missing some letters, my date of birth is wrong and most importantly the set fine is $265 instead of $490 as it should be?! What are my chances of fighting this ticket?? Thank you.

Response: Careless Driving is one of the most serious charges that can be issued under the Highway Traffic Act. We would have to look at the specifics of the alleged errors to see whether there would be a grounds to have the charge thrown out. If you would like to discuss your case with one of our staff, we offer a no-cost initial review of charges via our toll-free number 1-866-801-8299.
